Highly irrelevant. If they're colleagues, and it doesn't rise to the level of a criminal case, then it's still considered a work issue. Doesn't matter if it happened in the office, at the Red Bull christmas party, at the local pub, by text and whether it was within work hours or in their private hours.
Either it's a criminal issue, or it's a Red Bull issue.

In that case, just to clear up any potential misunderstandings, I'm not saying a civil lawsuit isn't possible. But it's gonna be against Red Bull, not Horner, and it's gonna be about Red Bulls handling of the case (as in, their HR practices) or the investigation, and not about whether or not Horner is innocent.
It's perfectly possible for both Horner to be innocent, but for Red Bull to be guilty of mishandling the case at the same time. But that's not gonna cast shadow on Horner. And it's unlikely to be a big headache for Red Bull, as you claimed. At least that's my legal take.
