He's a consultant now, not salaried staff. If he's inputting to the design/running of the race car then his costs are factored in to the cost cap. You can't get around it by changing how you pay someone. They are a cost centre irrespective of the contractual situation.
No. Newey was already contracted in a way to avoid his wages coming under the cost cap. His contract was with Redbull technologies not the F1 team if I remember correctly.
