New concorde questions

So, I already asked why Toyota could simply go out and close its team having signed new Concorde.
In Lotus article on autosport I found another interesting piece of info
That situation could change, however, when Lotus signs the Concorde Agreement - when it will then have to comply with a clause that demands no parts of its 2010 car have been designed by anyone working for another team
So, in he past it happened that team participated in F1 without signing Concorde. Is it possible now?
E.g. it seems that if Toro Rosso doesn't sign Concorde it may use RedBull designed chassis again.

If they don't sign the agreement they don't race is how i understoon. I thort it was a contract between bernie and the teams saying basicly i agree to race in f1 upto X date (i.e 2012 now) and i agree to these rules and regulations whist doing so

thats what it thought i was any way

I also understoon that as of next year torro rosso was making there own car anyway? But you never know, there may be exeptions etc. Who knows, its never published

so, BMW and Toyota's designers cannot work for anyone else under this agreement?

Not an expert, but as I understand it the designers cannot take their files and technical data with them if they switch teams, as those belong to the previous team. How it is regulated and enforced is another matter.

My guess is that spygate type scandles aren't regular, but maybe a particular designer's ideas might migrate with them from time to time. Looking at the big picture, each constructor's car is probably different enough that the same solution might not work for both teams, or at least not to the same extent.

Yes, the teams copy design concepts from other teams all the time.

This is different> is black and white contractual stuff that may leave quite a few people searching for positions with f2 teams or, to their worst nightmares, a1gp.
