A driver can communicate back and forth with the team for as long as it is after the race has started. The race was not suspended, thus it was still in progress even on the safety car restart lap. Ferrari got fined for having different amounts declared and actually in the car before the race. If you don't have at least 1L for sample at the end of a session as far as I remember penalty is DSQ. Last one I remember with that infringement was Hamilton in Q session at Catalunya in 2012. He was DSQ-ed from qualifying and had to start last while Maldonado inherited the pole and went on to win the race.
